Baltimore Rear-End Collision Attorney

Rear-end crashes are among the most common types of traffic collisions. Usually, they can be attributed to a texting driver running into a slowing vehicle, or vehicle stopped at a red light, or to an aggressive tailgating driver who, for some reason, is seemingly unable to control their impatience. If you were injured in a rear-end crash, we can help. The Baltimore rear-end collision attorneys at Berman | Sobin | Gross LLP can help you receive the compensation you are owed by the negligent driver who caused your injuries.

Causes of Rear-End Collisions

As with all traffic collisions, one (or more) of the following driver errors is likely the culprit when it comes to why your rear-end crash happened:

  • Distracted driving;
  • Aggressive driving;
  • Speeding;
  • Falling asleep at the wheel; or
  • Drunk driving.

Rear-End Drivers Are Not Always At Fault

Generally speaking, the following driver (the person who rear-ends the forward driver) is at fault in rear-end crashes. But while following too closely, either due to distraction or aggressive/impatient driving, is the predominant cause of rear-end collisions, the following driver is not always at fault. Sometimes, the forward driver’s erratic, unpredictable behavior is the cause. Two examples of when the forward driver may be at fault include:

  1. The forward driver slams the brakes on in a fit of road rage; and
  2. The forward driver merges/cuts the following driver off on the highway, and then quickly has to brake because of a slow down ahead.

Whiplash is a Serious Injury

It comes as little surprise that research published in the National Library of Medicine found that motor vehicle collisions is the leading cause of chronic neck pain. Whiplash is a real injury, though it is often difficult to diagnose. As opposed to a fracture or lacerated tendon, the soft tissue damage caused to the neck and upper back during whiplash is not likely to show up in an X-ray or CT-scan. Whiplash, according to the Mayo Clinic, is caused by the rapid back and forth motion of the victim’s head, and causes damage to the victim’s:

  • Discs;
  • Muscles;
  • Tendons; and
  • Ligaments.

The micro tears and damage caused to these tissues of the neck and upper back can take months or years to fully repair, or they may never heal fully, leaving the victim with chronic neck and back pain that manifests in headaches, immobility, pain, tingling in the arms and hands, difficulty moving the neck and upper body, and even changes in personality and emotions.

Other Common Injuries in Rear-End Collisions

  • Traumatic brain injury;
  • Fractures;
  • Spinal cord injuries;
  • Concussion;
  • Internal bleeding;
  • Lacerations;
  • Torn ligaments and cartilage;
  • Chronic back pain from a herniated disc;
  • Contusions; and
  • Facial injuries.
