Baltimore Car Accident Attorney

Traffic collisions are the leading cause of death for people between the ages of one and 54, according to the Centers for Disease Control and Prevention (CDC), and hundreds of thousands of people are severely injured every year in car crashes across the country. On top of the mental and physical toll that a serious road collision takes, many families struggle for years afterward with the financial strain that such an injury incurs. Here at Berman | Sobin | Gross LLP, our Baltimore car accident attorneys assist victims of car collisions for maximum compensation, so that they can one day get back to their lives without the burden of another person’s careless actions dictating every decision they have to take in the future.

Damages in a Baltimore Car Crash

Victims of collisions are compensated on the severity of their injuries, the damage to their vehicle, and many other factors. In order to accurately assess the true cost of the crash, it takes months, particularly when the victim’s injuries may lead to permanent disability. This is one of the reasons why personal injury lawsuits take as long as they do. Compensation for damages that you may be able to collect include the following:

  • Medical expenses;
  • Ongoing treatment and rehabilitation;
  • Lost earnings due to disability;
  • Lost earning capacity;
  • Pain and suffering;
  • Property damage;
  • Emotional distress;
  • Loss of joy of life; and
  • More.

Determining Fault in a Baltimore Car Crash

Many of the most serious (fatal) collisions in Baltimore are a result of drifting out of a lane, running red lights, and driving in the wrong lane—issues caused by distracted driving, intoxicated driving, and speeding. When a party is found responsible for causing a collision, their actions are described as “negligent.” Examples of negligence include texting while driving, drunk driving, speeding, driving aggressively, falling asleep while driving, and other forms of distracted driving such as using GPS or making a phone call. However, many crashes are not straightforward when it comes to proving fault, as more than one party may be found negligent. In the case where the victim is also negligent, the doctrine of contributory negligence may drastically reduce the compensation they can expect to receive. Contributory negligence works as follows: Driver A runs a stop sign, T-boning the victim, Driver B. If Driver B was doing everything in accordance with the law, they will not be found negligent for the crash. If they were texting while driving, for example, when they were hit, they could potentially be found partially responsible (liable) for the crash. The degree of their negligence reduces their compensation by an equal amount. So, if Driver A is 80 percent at fault, and Driver B is 20 percent at fault, their damages would be reduced by 20 percent.
